Pack the court room and get behind the council in its legal fight against multi-storey development at Lota House.
Please join us at the Planning and Environment Court, 415 George Street, Brisbane city on Thursday October 3 for the latest court hearing. Come along as an observer to see the council take on the developers. Bring your friends and neighbours to show the courts that we are still opposed to high rise development at historic Lota House. Don’t let Village Retirement Group and their lawyers decide what should be built in our community. Judges are people too and seeing the strength of the community’s concern could influence their decisions. We will email you the time and court room details next week. Parties urged to make a deal The October 3 review will be before Judge Nicole Kefford . Judge Kefford also heard the previous review ( August 27). At that time, she ordered that the parties (Village Retirement Group and the Brisbane City Council) attend a “without prejudice conference” run by the court’s Alternative Dispute Resolution Registrar. The “without prejudice conference” was to be held on or before September 27. No details have yet been released. Without prejudice conferences are used to help the parties resolve a dispute and avoid the need to take the matter to trial. Join us in court We need your support to go to the courts on Thursday October 3 and show the council and the court that the community is still opposed to high-rise at Lota House. If we can fill the gallery each time there is a hearing, we can convince the council that we want them to keep fighting on our behalf. The court is encouraging Village Retirement Group and council lawyers to come up with a compromise plan for development at Lota House. That could mean high rise goes ahead. More than 400 people have already signed a petition urging the council to keep fighting the appeal and not to compromise. See more on the court appeal Village Retirement Group v Brisbane City Council The appeal was lodged on April 4, 2019 by Village Retirement Group against the Brisbane City Council’s decision to say “no” to a high-rise retirement village at Lota House. A number of expert panels have been set up to advise the court and prepare reports. There are experts in architecture, town planning, visual amenity and needs . There are three needs experts, two appointed by Village Retirement Group and one appointed by the council. The needs experts are looking at issues like:
Contact the politicians The Village Retirement Group application required that the State government provide heritage and impact assessment comments. Despite publicly opposing the development, the state approved it and in doing so, ignored more than 150 public submissions against the application. Write to the State Development and Planning Minister, Cameron Dick Tell him you are dissatisfied with the State’s actions. Write to our local member, Joan Pease. Joan Pease publicly opposed the application. Ask her to convey your disappointment to the State Government offices that approved the application. Urge the council to keep fighting on our behalf.
